This course covers:
- The changes within the 1974 Act brought about by the Consumer Credit Act 2006 and its associated legislation.
- Changes to the enforceability of credit agreements,
- The new unfair relationships test and new ADR scheme operated by the Financial Ombudsman Service.
- Coverage of the Consumer Credit Act
- Understanding the terminology of the Act
- Licensing requirements and their enforcement
- Legal requirements in Consumer Credit Agreements
- Cancellation of credit agreements
- Interactions of the Sale of Goods Act, Supply of Goods (Implied Terms) Act and The Consumer Credit Act
- Hire Purchase and Conditional Sale Agreements
- Financial services (Distance marketing) Regulations 2004
Learning objectives
At the end of the course advisers will be able to:
- identify a regulated credit agreement
- identify information that should be contained within it
- identify any potential grounds for enforcement action
- identify rights related to different credit agreements
- transfer this knowledge so as to advise on contracts for the sale of goods and services
