This course covers:

  • Disciplinary Action at Work – statutory DDP’s – right to be accompanied
  • Detriment in disciplinary actions -
  • Wrongful Dismissal – Murray v Leisureplay
  • Unfair Dismissal – “new” Polkey – Pudney v Network Rail – B v BAA – Enterprise Liverpool v Bauress – SOSR –Kerry Foods v Lynch – Forshaw v Archcraft
  • Constructive Dismissal – Land Securities v Thornley –  Omilaju v Waltham Forest MBC
  • Automatic Unfair Dismissals – health and safety – whistle-blowing
  • Redundancy – consultation – Leicestershire County Council v Unison
  • Time Limits – Marks & Spencer v Williams-Ryan

Learning objectives

At the end of the course participants should be able to:

  • Explain the application of the statutory procedures on discipline and dismissal at work;
  • Understand the latest law on unfair and wrongful dismissal;
  • Advise on the new consultation law applying to a redundancy claim;
  • Identify appropriate time limits in dismissal cases
