E19 Advocacy in the employment tribunal

Course outline

Being able to act as an advocate in employment tribunal proceedings is a key skill for the employment adviser allowing you to:

  • make informed judgements about case preparation and improve the chance of fair settlements.  
  • avoid being pressured or intimidated into settlements where opponents are set on ‘having their day in tribunal’
  • appear in employment tribunals with a clear idea of procedure and how you are going to win your client’s case

Understanding what happens at the tribunal informs all the preparation that you do on a client’s case, the issues between the parties, the evidence that will be called, the way it is presented and examined as well as the legal submissions to be put forward by each party.

This two-day course will use a real case study to teach you the fundamental skills of appearing as an employment tribunal advocate in an environment where you can build confidence. Our tutors are experienced advocates who have appeared in the Employment Tribunal and the Employment Appeal Tribunal and they will guide you through the key skills, giving feedback at each stage.

In addition barristers from Cloisters, a leading employment law chambers, will be on hand to demonstrate key skills and give you tips on developing and improving your skills.  The course uses exercises drawn from real cases to illustrate and develop your skills.

Learning objectives

On the first day of the course you will learn how to:

  • describe the role of the employment tribunal in resolving disputes
  • identify the issues of law and fact relevant to a real case
  • draft a case plan
  • develop and apply a case theory
  • analyse the evidence that proves the issues of fact and law

On day two the learning focuses on applying these skills and you will:

  • make an opening and closing statement
  • introduce evidence in chief to prove your case
  • ask leading and non-leading questions
  • develop questions and questioning strategies for cross-examination
  • put legal submissions to a tribunal
