E43 Going bump: employment rights and insolvency

Course outline

When a business becomes insolvent the rights of the employees are often difficult to assess and enforce – often a lot of time is wasted just trying to understand what rights the employees have and against who.

This course aims to untangle some of the complexity in this area, give you a clearer idea of the rights that apply and how clients can obtain a remedy as quickly as possible.

This course will deal with:

  • types of business insolvency
  • the effect of insolvency on employees contractual and statutory rights
  • redundancy and unfair dismissal claims
  • the role of the National insurance Fund
  • protective awards
  • TUPE and insolvency

Learning objectives

By the end of this course you will be able to:

  • identify the different types of insolvency procedure that may affect employees
  • select the best route to recovery of losses for a client
  • explain when a protective award might be made
  • describe what claims can be made to the National Insurance fund
  • advise on the effect of the TUPE Regulations when insolvency arises
