Habitual  residence and the right to reside

Course outline

This course looks at the complex rules relating to benefits entitlement for people coming to the UK.  Suitable for experienced advisers with some understanding of the habitual residence test, the course will also look at the way EU provisions affect clients' rights. It would be an advantage, though not essential, for delegates to have a basic awareness of EU law.

Learning objectives

By the end of the course you will be able to:

  • describe what is meant by a settled intention to reside
  • explain what is meant by establishing a ‘right to reside’
  • determine the length of an ‘appreciable period of time’
  • determine the length of an ‘appreciable period of time’
