To address the current asymmetry in the appeals process, it is crucial that statutory consumer groups have the ability to effectively intervene on appeals and can bring additional appeal grounds. Consumer groups should have both (a) effective appeal rights and (b) a suitable cost recovery mechanism to make appeals and interventions viable in practice. The cost recovery mechanism should only apply to appeals that meet a public interest test.
